These Terms of Service ("Terms") govern the relationship between Endless Digital LLC, DBA Endless Local Reach ("we," "us," or "our") and any client ("you") who engages our web design or hosting services. By moving forward with a project or subscribing to a hosting plan, you agree to these Terms.
We offer two primary services:
Current pricing, tiers, and what's included in each are listed on our Pricing page. The specific package, price, and payment schedule for your engagement are confirmed with you before work begins.
Redesigning an existing website is not covered by the flat-rate Website Design & Build price above. Redesigns involve additional work to preserve your existing site's SEO rankings, including mapping and redirecting old URLs to the new site, and are scoped and quoted separately before any work begins.
All payments are made via credit or debit card through Stripe.
A deposit is due before work begins, with the remaining balance due when your site is ready to launch. Deposit and balance amounts depend on the package you choose (Website only, or Website plus one or both Coverage Add-ons) and are listed on our Pricing page or confirmed with your quote. Your site will not go live until the balance is paid in full.
Hosting is billed monthly on a recurring basis via Stripe. Your card on file will be charged automatically each billing cycle at the rate for your chosen plan (Basic, Standard, or Premium), as listed on our Pricing page at the time you subscribe. You authorize us to charge your card on file for the applicable monthly amount until you cancel.
You may cancel your hosting plan at any time by contacting us. Cancellation takes effect at the end of the current billing period — no further charges will be made after that date. We do not issue refunds for the current billing period upon cancellation.
If your hosting subscription lapses or is cancelled, your website will be taken offline. We are not responsible for any data loss or business impact resulting from a lapsed subscription.
Our goal is for every client to be satisfied with their website. If you are unhappy with the work, please contact us and we will work with you to make it right. Refunds are handled on a case-by-case basis at our discretion. The deposit is generally non-refundable once design work has begun, as it covers the time already invested.
The build price includes a reasonable number of revisions during the design and development phase. Once your site is live, ongoing revisions and content updates are handled through your monthly care plan. Standard and Premium plans include a monthly page credit (currently 1 for Standard, 2 for Premium, as detailed on our Pricing page) that can be used for a new page or a major update to an existing one. Credits do not roll over, and nothing is added automatically — you tell us what to use it on.
Larger post-launch work that falls outside your plan's included credits, or work outside the original build scope, will be scoped out and quoted separately before any work begins.
Upon receipt of full payment for the website build, all rights to the design and code for your website transfer to you. Until full payment is received, we retain all rights to the work product. We reserve the right to display your completed website in our portfolio unless you request otherwise in writing.
You are responsible for providing accurate content (text, images, logos) in a timely manner. Delays in providing content may delay your project timeline. You represent that you own or have the right to use any content you provide to us.
Domain names are not included in the build price. You purchase and own your domain directly. We are not responsible for domain registration, renewal, or expiration.
To the fullest extent permitted by law, Endless Digital LLC shall not be liable for any indirect, incidental, or consequential damages arising out of or related to our services. Our total liability to you for any claim shall not exceed the total amount paid by you to us in the three months preceding the claim.
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Utah.
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of our services after changes constitutes your acceptance of the updated Terms.
